NWRB DEPUTIZE DENR ON CERTAIN FUNCTIONS OF WATER USE REGULATION

To properly implement the Water Code of the Philippines, the National Water Resources Board (NWRB) deputized the Department of Environment and Natural Resources (DENR) to perform certain functions of water use regulations in the country.

The NWRB is the national regulating and coordinating agency on water resources management and development and is mandated to implement the Water Code of the Philippines. It is tasked to conduct monitoring and enforcement activities all over the country.

Some of the certain functions of water use regulations deputized to the DENR regional offices under the Licenses, Patents and Deeds Division (LPDD) are to accept/verify water permit applications, conduct continuing inventory of water users, identify water sources and make sources inventory map.

Types of water permit application include water permit for agricultural purposes, Hydraulic power development and industrial purposes, municipal purposes and recreational, fisheries and other purposes.

The LPDD shall serve as NWRB's Deputy in the DENR Regional Offices to perform some functions relative to regulation of water use to complement the existing deputized agents such as the Department of Public Works and Highways, National Irrigation Administration and some water districts.

DENR conducted series of information, education and communication campaign on the Water Code of the Philippines and Its Implementing Rules and Regulations to key stakeholders in collaboration with NWRB, re-echo training for PENROs and CENROs and coordination meetings with other deputized agents in the area, and other related activities assigned in accordance with the Water Code.

The Water Code of the Philippines aims to establish the basic principles and framework relating to the appropriation, control and conservation of water resources, define the extent of the rights and obligations of water users and owners including the protection and regulation of such rights, and adopt a basic law governing the ownership, appropriation, utilization, exploitation, development, conservation and protection of water resources and rights to land related thereto. P. D. 705 VIOLATOR SENTENCE TO 26 YEARS INPRISONMENT BY COURT

Cagayan de Oro City- For illegally transporting undocumented forest products and for failing to present pertinent papers issued by the government,  Judge Evelyn J. Gamotin-Nery, Acting Presiding Judge of the Regional Trial Court Branch 11 in Manolo Fortich, Bukidnon convicted a certain Pepe Tacastacas for violating Section 68, P.D. 705 as amended by Executive Order No. 277, Series of 1997.

Tacastacas was sentenced to the penalty of imprisonment of 21 years, 2 months and 10 days to 26 years, 4 months and 20 days, for having unlawfully transported a total of 805.96 board feet of lumber flitches on April 19, 2013 at Barangay Kiabo, Malitbog, Bukidnon without the required authority of permit with the use of his Fuso canter truck bearing plate No. TMR-621.

The court also acquitted co-accused John Benjamin Sepulveda, the nephew of Tacastacas’ wife and truck helper who turned state witness and testified the transportation and hauling of the undocumented forest products..

During the preliminary hearing, P/Insp. Joseph Molo of PNP-Malitbog along with PSI Russel Chaves, PO2 Richard Omongos and PO1 Renard Dilag alledged that after they received a tip from a reliable source. The team proceeded to the place and intercepted a conveyance driven by Tacastacas accompanied by Sepulveda and loaded with undocumented forest products towards the direction of Sta. Cruz, Claveria, Misamis Oriental.

The Community Environment and Natural Resources (CENR) Officer Ferdinand Dagulo, then OIC of CENRO-Manolo Fortich accompanied by Forester Mark Espital and Noel Jabagat conducted inspection on the conveyance and accounting of apprehended forest products.

Prosecution witnesses P/Insp Molo, Noel Jabagat of CENRO-Manolo Fortich testified to the court that the suspect during the apprehension has no permit while transporting the said forest products.

After weighing all the circumstances and explanations of the witnessess, the court then convicted and orders a Warrant of Arrest for Pepe Tacastacas and confiscation of the 805.96 bd. ft. of lumber flitches with the total amount of P644,768.00 and will be turned over to the government.
